Terms of service
These terms are the agreement between you and Window Seat LLC ("we", "us") for using Window Seat at takethewindowseat.com.
Agreeing to these terms
When you make an account, you tick a box to agree to these terms and the privacy policy. If you don't agree, please don't use Window Seat.
Who can use it
You must be 13 or older to make an account. If you're under 18, a parent or guardian should agree to these terms with you. You can add people you look after, like your kids, as travelers on your trips. You're responsible for what you enter about them.
Your account
Keep your sign-in to yourself. You're responsible for what happens under your account. Tell us at privacy@takethewindowseat.com if you think someone else got in.
Your trips and what you add
What you add to Window Seat stays yours. You give us permission to store it, show it to the people on your trips, and copy it as needed to run the app. That permission ends when the content is deleted, except for backups we keep for a short time and content that other people on the trip still rely on, like shared expenses.
Other people on your trips can see and, depending on their role, change trip content. Admins can manage people and settings. Anyone on a trip can propose, vote, sign up and mark things booked. Only add what you're comfortable sharing with the people on that trip, and only add someone else's details if they're OK with it.
Money tracking
Window Seat keeps a record of who paid what and works out who owes whom. It does not move money, hold money or make payments. Settling up happens outside the app, between you and the others. Check amounts and exchange rates before you pay anyone. Exchange rates come from a public source and may differ from your bank's.
Travel information
We're not a travel agent and we don't book anything. Flights, stays and reservations are between you and the companies you book with. Weather, travel times, "leave by" estimates, entry and visa reminders, and nearby hospitals are rough guides from outside sources. They can be wrong or out of date. Always check with the airline, hotel or official source.
The Emergency sheet is a convenience, not an emergency service. In an emergency, call the local emergency number first.
Beta and pricing
Window Seat is in beta. It's free while in beta. Proposing, voting, the plan, the shared tab, settling up and inviting people will stay free. We may add paid extras later. We'll tell you before anything costs money, and we'll never charge you without your clear agreement. As a beta, features may change, break or go away.
Fair use
Don't use Window Seat to:
- break the law or violate someone else's rights
- harass, threaten or deceive people
- upload malware, or anything you don't have the right to share
- try to get into accounts, trips or data that aren't yours, or get around the app's privacy rules
- overload or scrape the service, or resell it
Copyright complaints
If you believe something on Window Seat infringes your copyright, send a notice to our designated copyright agent:
- Copyright Agent, Window Seat LLC
- Mail: [mailing address]

- Email: privacy@takethewindowseat.com
Your notice should include:
- Your signature (typed is fine) and contact details.
- The work you say is being infringed.
- Where the material is on Window Seat, in enough detail for us to find it.
- A statement that you believe in good faith the use isn't authorized by you, your agent or the law.
- A statement, under penalty of perjury, that your notice is accurate and you're the owner or allowed to act for the owner.
If we remove something you added and you think it was a mistake, you can send a counter-notice to the same agent. We close the accounts of people who repeatedly infringe.
Our part
The app, its design, name and logo belong to us. You can use them only to use Window Seat.
Feedback
If you send us ideas or suggestions, we can use them freely, without owing you anything.
Ending things
You can stop using Window Seat and ask us to delete your account at any time. We may suspend or close an account that breaks these terms, or if we have to for legal reasons. If we ever shut Window Seat down, we'll give at least 30 days' notice so you can save what you need.
Disclaimers
Window Seat is provided "as is" and "as available". To the extent the law allows, we make no promises that it will always work, be error-free, or keep your data forever. Keep your own copies of important bookings and documents.
Limits on liability
To the extent the law allows, we're not liable for indirect or consequential losses, like missed flights, lost bookings or disputes between travelers. Our total liability to you for any claim is limited to the greater of what you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not apply to you.
Your responsibility for claims
If someone makes a claim against us because of content you added or because you broke these terms, you agree to cover our reasonable costs, including legal fees, to the extent the law allows. We'll let you know about the claim and work with you on it.
The law that applies
These terms are governed by the laws of the State of New York. Any dispute will be handled in the state or federal courts in New York County, New York, unless the law where you live says otherwise.
Changes
We may update these terms. If a change matters, we'll post the new version here with a new date, tell you in the app or by email before it takes effect, and ask you to agree to it the next time you sign in. Smaller changes, like fixing a typo, take effect when posted.
The rest of the fine print
These terms and the privacy policy are the whole agreement between you and us about Window Seat. If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms right away, we haven't given up the right to enforce it later.
